Terms of Service

These Terms of Service (“Terms”) govern your use of the Reimagine AI website builder and all related services (collectively, the “Service”) operated by Reimagine AI (“Reimagine”, “we”, “us”, or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Reimagine is an AI powered website builder that generates custom websites based on user input. You provide a description of your business, upload images, and interact with an AI assistant. The Service then generates website code (Vite + React with Tailwind CSS) including layouts, text, and images.

The Service is provided “as is” and “as available”. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

2. Accounts

To use the Service, you must create an account via our authentication provider Clerk. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must be at least 16 years old to use the Service.

You agree to provide accurate information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits and Subscriptions

3.1 Credits

The Service operates on a credit based system. Credits are consumed when you generate websites, sections, images, or use the Builder Chat. The number of credits consumed depends on the type and complexity of the operation.

Credits do not expire. Once purchased or received as part of your plan, your credits remain in your account until used.

3.2 Subscriptions

Paid plans are billed on a recurring basis (monthly or yearly) via Stripe. Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date.

You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to your plan features and remaining credits until the period ends.

3.3 Refunds

All purchases of credits and subscriptions are final and non-refundable. This includes cases where AI generated output does not meet your expectations, contains errors, or differs from what you described. Because AI generation consumes computational resources at the time of use, credits cannot be returned once consumed.

If you experience a technical issue that prevents the Service from functioning (e.g. a generation fails entirely due to a server error), please contact us at support@reimagine-app.com and we will review your case on an individual basis.

4. AI Generated Content

4.1 Nature of AI Output

The Service uses artificial intelligence to generate website code, text, layouts, and images. AI is a probabilistic technology and the output may:

• Contain errors, inaccuracies, or unexpected results
• Not exactly match the description or instructions you provided
• Include text or visual elements that need manual correction
• Produce different results each time, even with the same input
• Generate code that requires testing before deployment

You acknowledge and accept that AI generated output is not guaranteed to be error free, complete, or exactly as described. You are responsible for reviewing, testing, and validating all generated content before publishing or deploying it.

4.2 No Guarantee of Results

We do not guarantee any specific outcome, quality level, or conversion rate from websites generated by the Service. Results vary based on the input you provide, the complexity of your requirements, and the inherent limitations of AI technology.

5. Ownership and Intellectual Property

5.1 Your Content

You retain all rights to content you upload to the Service, including logos, product photos, screenshots, and text. You are solely responsible for ensuring you have the right to use any content you upload. Do not upload copyrighted material that you do not own or have permission to use.

5.2 Generated Code

You own the code generated by the Service. Once your website is generated, the output code (React components, CSS, HTML, configuration files) belongs to you. You are free to download, modify, distribute, and deploy it without restriction. No attribution to Reimagine is required. No ongoing license fee applies.

5.3 AI Generated Images

Images generated by the AI as part of your website are provided for your use within your project. However, AI generated images are created using machine learning models and we cannot guarantee exclusive rights or uniqueness. Similar visual elements may appear in output generated for other users.

5.4 Our Intellectual Property

The Service itself, including its design, branding, logo, codebase, AI models integration, and proprietary technology, remains the intellectual property of Reimagine AI. These Terms do not grant you any rights to our trademarks, branding, or proprietary systems.

5.5 Showcase and Demo Websites

Reimagine may display example websites on its website, marketing materials, and social media channels for demonstration and showcase purposes only. These example websites may feature fictional or real brand names, logos, products, or company names. Such showcase content is purely illustrative and does not imply any affiliation, endorsement, partnership, or sponsorship between Reimagine and the brands or companies depicted. All trademarks, brand names, and logos shown in showcase examples remain the property of their respective owners.

6. Acceptable Use

You agree not to use the Service to:

• Create phishing websites, scam pages, or any content designed to deceive or defraud others
• Generate websites that promote illegal activities, hate speech, violence, or discrimination
• Create content that infringes on the intellectual property rights of others
• Attempt to reverse engineer, extract, or replicate our AI systems or proprietary technology
• Abuse the Service through automated scripts, bots, or any method designed to circumvent usage limits
• Resell, redistribute, or sublicense access to the Reimagine platform itself (e.g. sharing your account credentials or selling access to your Reimagine account). This does not restrict your right to sell, deliver, or distribute websites you have generated using the Service to your clients, customers, or any third party.

We reserve the right to suspend or terminate your account immediately and without refund if we determine that you have violated these acceptable use policies.

7. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We are not liable for any loss or damage resulting from service downtime.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Reimagine AI and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Damages arising from AI generated output (errors, inaccuracies, or unintended content)
• Damages resulting from unauthorized access to your account
• Any damages exceeding the total amount you paid to Reimagine in the 12 months preceding the claim

You agree that you use the Service at your own risk and that our total liability is limited to the amount you have paid us in the 12 months before the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Reimagine AI, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Content you upload or generate using the Service
• Websites you create, publish, or distribute using the Service
• Your violation of these Terms
• Your violation of any third party rights

10. Account Termination

You may delete your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we are required to do so by law.

Upon termination, your right to use the Service ceases immediately. We may delete your project data and uploaded files within 30 days of account termination. Code you have already downloaded remains yours.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Offenbach am Main, Germany.
